This Privacy Policy ("Privacy Policy") describes how Tube, Inc. (the "Company", "we", "us" or "our") collects, uses, discloses and otherwise processes personal information in connection with MyLiine, including our websites, applications, text-messaging features and related services (the "Service").
Capitalised terms not defined in this Privacy Policy have the meanings given in The Liine Terms of Service (the "Terms"). This Privacy Policy is incorporated by reference into the Terms.
Some of our services may be covered by different privacy policies. In particular, this Privacy Policy does not apply to our mobile services, which are governed by the applicable privacy policy for those mobile services. If there is a conflict between this Privacy Policy and another privacy policy of the Company, the product- or service-specific policy governs.
This Privacy Policy applies to Organizers, Contributors, Beneficiaries, Payers and other individuals whose personal information we process through the MyLiine Service. It is intended to provide notice of our practices, as required by applicable US federal and state privacy and data protection laws ("Privacy Laws"). It is not a contract and does not create any contractual rights or obligations, except to the extent required by applicable law.
1. Types of Information We Collect and Its Sources
Personal information. Personal information is information that we directly associate with a specific person or household, for example, name, address, email address, username and password. Personal information does not include "de-identified", "anonymous" or "aggregate" information that cannot be associated with a specific person or household.
Information you choose to provide. The MyLiine Service is designed for sharing personal memories. Information may be shared by Organizers and Contributors for the benefit of Beneficiaries. Messages and media may include and reveal information about you, your household, your relatives or others, including their political views, health, religious beliefs or other sensitive matters. Please consider carefully what you choose to share. Messages and media may also include images, voices or information about people who are not Users, including children. The User who submits that content is responsible for obtaining any consents required to share it.
The categories of personal information we collect about you depend on how you use the Service, and may include the following:
(a) Identifiers, personal records and commercial information, such as name, email address, mobile telephone number, the MyLiine Number, account identifiers, billing address, limited payment information, subscription plan, purchases, fees paid, transaction history, IP address and device identifiers. Organizers, Payers or any other User may provide this information about themselves or others. We may also collect it automatically from devices and messaging providers, including through cookies or similar technologies.
(b) Characteristics of protected classifications, such as age or date of birth, where provided (for example, a Beneficiary's handover date or age). Organizers, Payers or Contributors may provide this information.
(c) Internet or other electronic network activity, such as log data, access times, pages and features used, message delivery records, and browser and device type. We collect this information automatically from devices and from our messaging providers.
(d) Geolocation data, such as approximate location inferred from IP address or area code. Precise location may be contained in photo or video metadata if the sender's device includes it. We collect this information automatically, or it is embedded in User Content.
(e) Audio, video, electronic, visual or similar information, such as messages, photographs, videos, audio recordings and files, including any people shown in them, any associated metadata (such as date, time, device and location), and account log-in credentials. Many devices automatically embed metadata in photographs and videos, which may include the date, time, device information, and precise location where they were taken. When you send media through the Service, we may remove some or all of that metadata, store it along with the media, or both, in accordance with our practices in effect from time to time. You can usually turn off location tagging in your device's camera settings before taking photos or videos. Any User who sends or uploads content may provide this information, including Organizers, Contributors and Payers.
(f) Performance and diagnostic data, and inferences. We may collect performance and diagnostic data about your use of the MyLiine Service, including on your device and through the My Liine Number. This includes content classifications and moderation outcomes generated by automated tools (for example, whether content may breach the Terms), and the categorisation of memories for compilations or search. Our service providers and we generate this information.
In addition to the sources described above, we may also receive personal information from our service providers, such as payment processors (for example, confirmation of payment status) and identity-verification providers.
We do not intentionally collect biometric information. Except as described in Section 4, we do not use photographs, videos, or audio to identify individuals by facial or voice recognition.
2. How We Collect the Information
The Company collects personal and other information about you in several ways.
Information you choose to provide. Information may be given to us by you or by other parties including the Organizer or the Contributors, or we may collect it as described in Section 1.
Mobile application and third-party sites. This Privacy Policy applies to the mobile application available on Google Play and operated for the benefit of the Company. Third-party providers whose sites are featured on, and accessed through, our website may also collect information. Such collection and use of your information is governed by the third party's privacy policy.
Order and service contact. If we have trouble processing your order, we use the contact information you provide to get in touch with you. We also use this contact information to provide you with updates about your current phone or service, and information about the Company's promotions and special offers.
Contests and promotions. The Company may offer the opportunity to participate in contests, giveaways, or other similar promotions that we sponsor. Except as explained otherwise in the rules for a particular contest, giveaway or promotion, any personal information you provide will be used in accordance with this Privacy Policy.
Cookies and similar technologies. We may link information we collect automatically with personal information, such as information you give us at registration and checkout. We may use systems or tools, including cookies, web beacons and other mechanisms, along with analysis of network and device information, to follow your use of our Services and other applications. For example, we may allow analytics service providers to collect site click-stream and cookie data to help us track aggregate and individual use of our Services. We sometimes use cookies to enable features on our sites, such as saving your shopping cart, setting preferences or serving ads to you. The information we receive through cookies, web beacons and other mechanisms may enable us to recognise users across devices, such as smartphones, computers and tablets, and related browsers.
Information from other sources. We may obtain information about you from outside sources and add it to, or combine it with, your account information. For example, we may receive background information from third-party sources in connection with know-your-customer verification or fraud prevention. We may also use commercially available demographic and marketing information from third parties to help us serve you better, or to inform you about products or services that we think may interest you.
Advertisers and ad networks. Advertisers, ad networks and other third parties that serve ads on our sites may also use their own mechanisms, including cookies. These third-party cookies and tools are governed by the privacy policies of the entities placing the ads, not by this Privacy Policy.
3. How We Use Personal Information
We may use personal information for the following business and commercial purposes:
(a) Providing the Service, including reserving and operating Line Numbers; receiving, storing, organising and delivering messages and media; managing Contributors; generating compilations, summaries and search results; storing, holding and releasing Archives, including Sealed Items; and carrying out transfer of the Archives to you including the Handover.
(b) Accounts and verification: creating and administering Accounts, verifying identity and mobile numbers, and managing access permissions.
(c) Payments: determining the appropriate pricing for your service; processing fees, managing subscriptions and renewals, and keeping transaction records; and providing and billing for products and services you purchase and charge to your account.
(d) Communications: sending service, transactional and administrative messages, including by text message and email; responding to enquiries and support requests; delivering and confirming products and services you obtain from us; and developing, or informing you of, new products and services.
(e) Safety, security and integrity: detecting, preventing and responding to fraud, abuse, spam, unlawful content, security incidents and breaches of the Terms, including through automated content moderation (see Section 4); and protecting our rights and property and those of our customers.
(f) Improving the Service: debugging, testing, analysing usage and performance, and developing new features; and monitoring, evaluating or improving our products, Services, systems or networks.
(g) Anonymised and aggregated information: anonymising or aggregating personal information for purposes such as market analysis and traffic flow analysis and reporting and, where practicable, for improving the Service as described above.
(h) Advertising: customising or personalising online advertising to bring you information about products and services of the Company or others that may interest you, including co-branded offers.
(i) Compliance: complying with laws, regulations, legal processes and requests from authorities; enforcing our Terms; and establishing, exercising or defending legal claims.
(j) Business transfers: in connection with a merger, acquisition, financing, reorganisation, bankruptcy or sale of all or part of our business or assets.
(k) Other purposes disclosed to you at the time of collection, or with your consent.
We do not use the content of your messages or media for targeted or cross-context behavioural advertising.
4. Artificial Intelligence and Automated Processing
AI-assisted features. The Service may use artificial intelligence, machine-learning and other automated tools, which may be provided by, or used in conjunction with, third-party vendors acting as our service providers. These tools may be used to:
analyse, classify and moderate messages and media, including Sealed Items, to detect fraud, misuse, malicious code, and content that is sexually explicit, harmful or otherwise in breach of the Terms;
generate summaries, compilations, suggestions and search results; and
support customer service and the security of the Service.
Automated decisions. Based on the output of these tools, the Service may automatically take actions without human review or intervention. These actions include blocking, quarantining or deleting content; restricting uploads or features; flagging content for review; and suspending access in accordance with the Terms. Automated tools are not perfect and may produce inaccurate results. If you believe an automated action was taken in error, you may contact us at legal@myliine.com. We are not obliged to reverse any action, except as required by applicable law.
The automated decision-making technology currently contemplated is not intended to make decisions that produce legal or similarly significant effects concerning individuals, such as decisions about financial or lending services, housing, education, employment or healthcare, within the meaning of applicable Privacy Laws. If this changes, we will provide any notices and rights required by law.
No facial or voice recognition. We do not use photographs, videos or audio recordings to create facial templates, voiceprints or other biometric identifiers, or to identify individuals, unless such recognition is made available as part of a feature of the MyLiine Service. Where we offer such a feature, we will provide notice and obtain any consent required by applicable law, and you may be given the option to turn off or opt out of the feature.
AI vendors. Our AI and other technology vendors receive personal information only as necessary to provide their services to us, under written contracts that restrict their use of it as required by applicable Privacy Laws for service providers, contractors and processors.
5. Information We Share
No sale or sharing. We do not sell personal information. Except for advertising cookies and similar technologies on our websites, which you may reject as described in Section 7, we do not share personal information for cross-context behavioural advertising or process it for targeted advertising, as those terms are defined in applicable Privacy Laws. We do not use the content of messages or media sent through the Service for advertising. We have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age.
Disclosures for business purposes. We may disclose personal information to the following categories of recipients:
(a) Cloud hosting, storage and infrastructure providers, for hosting, storing and backing up the Service and User Content. We may disclose all categories of personal information to third parties who perform services on our behalf, including hosting, cloud and infrastructure services.
(b) Telecommunications and messaging providers (for example, SMS/MMS aggregators and carriers), for assigning MyLiine Numbers and routing and delivering messages. We may disclose identifiers; audio, electronic, visual or similar information; geolocation data; internet or other electronic network activity; and sensitive personal information to them.
(c) AI and content-moderation providers and data aggregators, for content analysis and moderation, compilations, summaries and search (see Section 4). We may disclose identifiers; audio, electronic, visual or similar information; geolocation data; inferences; and sensitive personal information to them.
(d) Payment processors, for processing Fees and subscriptions. We may disclose identifiers, personal records and commercial information to them.
(e) Identity-verification, security and fraud-prevention providers, for verifying Users and protecting the Service. We may disclose identifiers; internet or other electronic network activity; geolocation data; and sensitive personal information (such as account log-in credentials) to them.
(f) Customer support, analytics and communications tools, for responding to requests and operating and improving the Service. We may disclose identifiers, internet or other electronic network activity, and commercial information to them.
(g) Professional advisers, for legal, accounting, audit and insurance services. We may disclose any category of personal information described in Section 1 to them, as needed.
These recipients act as our service providers or contractors and are contractually restricted from using personal information other than to provide services to us, or as otherwise permitted by applicable Privacy Laws.
Other Users. By design, the Service may make User Content available to other Users of the relevant MyLiine account (for example, the Archives contributed by the Contributors may be accessed by the other Contributors, Organizers, the Beneficiary, or any other designated User), including in accordance with the Organizer's settings, the Terms and any applicable release condition. Contributors' names and mobile numbers may be visible to the Organizer and, where the Service allows, to other members of the MyLiine.
Legal and safety. We may disclose personal information where we believe in good faith that disclosure is required or appropriate to comply with law, regulation, legal process or a governmental request; to protect the rights, property or safety of the Company, our Users or others; or to detect, investigate or report suspected unlawful activity.
Business transfers. Personal information may be disclosed or transferred as part of a merger, acquisition, financing, reorganisation, bankruptcy or sale of all or part of our business or assets.
Affiliates. We may disclose personal information, including payment history and transactional information, to our affiliates for the purposes described in this Privacy Policy.
With your direction or consent. We may disclose personal information where you direct us to, or with your consent.
6. Sensitive Personal Information
Some information processed through the Service may be considered sensitive personal information or sensitive data under applicable Privacy Laws. This includes the contents of text messages and other communications, account log-in credentials, and precise geolocation that may be embedded in photo or video metadata.
We use and disclose sensitive personal information only for purposes required to provide you the MyLiine Services and to the extent otherwise required or permitted under applicable Privacy Laws, or with your consent where required. These include providing the Service you request; ensuring security and integrity; detecting and preventing fraud and unlawful activity; performing services on our behalf; and maintaining the quality and safety of the Service.
We do not use sensitive personal information to infer characteristics about you. Accordingly, we do not currently offer a separate right to limit the use of sensitive personal information. If our practices change, we will update this Privacy Policy and provide any rights required by law.
7. Information Choices and Changes
Choosing not to provide information. You can choose not to provide us with certain information, but this may prevent you from using certain features of our websites or receiving certain products or services. Public forums are not intended for the disclosure of personally identifiable information. If you provide personally identifiable information in any public forum, you do so at your own risk.
Marketing contacts. We offer you choices about how we contact you for marketing-related communications:
You may tell us that you do not want us to contact you for marketing purposes by contacting the Company at support@myliine.com or 3512080121. You can also opt out using the unsubscribe link at the bottom of applicable emails.
If you register a do-not-contact request with us, we may still contact you for non-promotional purposes, such as emails or wireless messages related to your account or our ongoing business relationship, or when you initiate the interaction.
Advertising. We do not control third parties' collection or use of your information to serve interest-based advertising. You may be able to opt out of receiving personalised advertisements from companies that are members of the Network Advertising Initiative or that subscribe to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising. For more information about this practice and your options, please visit http://www.aboutads.info and http://www.networkadvertising.org/choices/. You can set preferences for how Google advertises to you using the Google Ad Preferences page and, if you wish, you can opt out of interest-based advertising permanently using a browser plug-in.
Please note that if you opt out, you will continue to receive the same number of ads, but they may be less relevant because they will not be based on your interests. You may still see ads related to the content of a web page or based on other non-personal information. This opt-out is cookie-based. If you change computers or devices, change web browsers or delete cookies, you will need to visit the AboutAds site and opt out again.
Do Not Track. Your web browser may offer a "Do Not Track" option, which allows you to signal to operators of websites, web applications and services (including behavioural advertising services) that you do not wish them to track certain of your online activities over time and across different websites. Because the internet industry is still working on Do Not Track standards, implementations and solutions, we do not currently recognise or respond to browser "Do Not Track" signals or other mechanisms that let you choose how personally identifiable information about your online activities is collected over time and across third-party websites or online services.
Cookies and other tracking technologies. We use necessary cookies, which are required for our websites and the Service to function, and performance cookies, which help us understand and improve how they perform. With your choice, we may also use advertising, targeting, and other cookies and similar technologies that are not strictly necessary or performance cookies. You can accept or reject those cookies at any time through the cookie settings on our websites. You can also set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some or all parts of the Services may be inaccessible or may not function properly.
Global Privacy Control. We do not sell personal information. As mentioned above, you can reject advertising and other cookies that are not strictly necessary or performance cookies through our cookie settings. Where required by law, we will also treat an opt-out preference signal, such as Global Privacy Control, as a request to opt out of those cookies for the browser or device that sends it. For Do Not Track signals, see paragraph titled “Do Not Track” above. Account information. If you would like to change certain Company account information, you may create an online account and manage your account online.
Requests about your information. Whether or not you are a User, if you believe the Service holds your personal information, you may contact us at legal@myliine.com. We will respond as required by applicable law. Content held in an Archive may also be subject to the rights of other Users. Where we are permitted to do so, we may refer your request to the relevant Organizer.
Contributor messages. We use a Contributor's mobile number to route messages to and from the MyLiine, and to send service messages. Contributors may opt out of text messages by replying STOP. Opting out does not automatically delete content already in an Archive.
8. Children's Privacy
The Service is intended for use by adults, including on behalf of children. It is not directed to children under 13. We do not knowingly collect personal information directly from children under 13 without the verifiable consent of a parent or legal guardian, as required by the Children's Online Privacy Protection Act ("COPPA").
Organizers and Contributors may share content about, or showing, a child Beneficiary or other children. A parent or legal guardian who has established MyLiine is responsible for the content they choose to share. They may review, download, or delete their child's information through the MyLiine Service, or by contacting us at support@myliine.com.
If we learn that we have collected personal information directly from a child under 13 without the required consent, we will take steps to delete it as required by law. If you believe this has happened, please contact us.
Minors. If you are under 18 and have posted content to the Service, you may request removal of that content by contacting us at support@myliine.com. Removal may not ensure complete or comprehensive removal of the content, for example where it has been copied or re-shared by others.
9. Retention
The Service is designed to keep memories for long periods, potentially many years, until transfer of the Archive or the Handover and for a period thereafter. We retain each category of personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, using the criteria below, unless a longer period is required or permitted by law.
(a) Account and contact information (identifiers and personal records) is retained for as long as the Account or MyLiine Service is active, and for a reasonable period afterwards to deal with enquiries, disputes and legal obligations.
(b) User Content and associated metadata, including Sealed Items, is retained for as long as the MyLiine Service remains active and the content has not been deleted, including until any Release Condition is met and through Handover. Deletion is governed by the Terms and Section 10.
(c) Commercial and payment information is retained for as long as needed for billing, and as required by tax, accounting and other legal obligations.
(d) Network activity and log data are retained for as long as needed for security, troubleshooting and analytics, generally for a limited period, unless needed to investigate an incident.
(e) Inferences and moderation records are retained for as long as needed for safety, integrity and legal purposes, which may extend beyond the deletion of the underlying content.
Deleted content may remain in backup systems for a limited period, as may be specified in our Product Documentation, before it is overwritten. We may retain de-identified or aggregated information indefinitely.
10. Your Privacy Rights
Depending on where you live, and subject to the exceptions and limitations in applicable Privacy Laws, you may have the following rights:
Right to know: to request that we disclose the categories of personal information we have collected about you; the categories of sources; the business or commercial purposes for collecting it; the categories of third parties to whom we disclose it; and the specific pieces of personal information we hold about you, including a copy in a portable format where required.
Right to delete: to request that we delete personal information we have collected from or about you.
Right to correct: to request that we correct inaccurate personal information.
Right to opt out of sale or sharing: we do not sell or share personal information, as described in Section 5.
Right to limit use of sensitive personal information: see Section 6.
Right to non-discrimination: we will not discriminate against you for exercising your rights.
Limits on these rights. We may deny a request, in whole or in part, where permitted by law. Examples include where we cannot verify your identity; where the information is needed to complete a transaction, ensure security, prevent fraud, or comply with a legal obligation; where fulfilling the request would adversely affect the rights of others, including information in an Archive that relates to other Users or that another User submitted; or where an exemption applies. Where we deny a request, we will explain why, as required by law.
How to submit a request. You may submit a request by email to legal@myliine.com, or by calling our support number at3512080121. Please describe your request in enough detail for us to understand and respond to it.
Verification. We will take reasonable steps to verify your identity before responding to a request to know, delete, or correct. This may include matching information you provide with information we hold, or sending a verification code to your registered mobile number or email. The level of verification depends on the sensitivity of the information and the nature of the request.
Authorised agents. You may use an authorised agent to submit a request on your behalf. We may require written and signed permission from you; that you verify your own identity directly with us; and that you confirm directly with us that you gave the agent permission.
Timing. We will acknowledge requests to know, delete, or correct within ten (10) business days, and respond within forty-five (45) calendar days. Where reasonably necessary, we may extend that period by a further forty-five (45) days or for such further periods as may be permitted by law, and to the extent required by law, with notice to you.
Financial incentives. Except for any testimonial contest that we may conduct from time to time, we do not offer financial incentives in exchange for personal information. Any such contest is governed by its own terms, and any related notice of financial incentive will be provided as required by law.
11. Appeals
Appeals. Where applicable law provides a right to appeal, and we decline your request, you may appeal by replying to our decision or by emailing legal@myliine.com with the subject line "Privacy Appeal". We will respond within the time required by applicable law.
12. Security, Location of Processing and Third-Party Links
Security. We use reasonable administrative, technical, and physical measures designed to protect personal information. However, no method of transmission, storage or processing is completely secure. Text messages sent over carrier networks are not end-to-end encrypted. We cannot guarantee the security of any information, and you use the Service at your own risk. You are responsible for keeping your devices, mobile number, and access credentials secure.
Location of processing. We are based in the United States. We and our service providers may process personal information in the United States and in other countries where our technology and customer support centres may be located, including from India. By using the Service, you acknowledge that your personal information may be processed in those locations.
Third-party links and services. The Service may link to, or integrate with, websites and services operated by third parties, including payment and social media platforms. Their privacy practices are governed by their own policies, and we are not responsible for them.
13. Changes to This Privacy Policy
This Privacy Policy is subject to change. If we change this Privacy Policy, we will post the updated Policy promptly. When we change the Privacy Policy, we will give notice by updating the "Last Updated" date, or as otherwise required by law. By using https://myliine.com, you agree that your visit to our site and your use of our Services are subject to this Privacy Policy and our Terms.
14. Survival
This Privacy Policy will remain in effect even if the Terms and any other agreements between us are terminated, and you are no longer using the Site, the Service, or any other Company services.
